Positive und negative Religionsfreiheit als Grundrechte für alle verfassungstheoretische Perspektiven

The article discusses the coexistence of positive and negative religious freedom in German religious constitutional law. He shows that the formats of positive religious freedom are not "privileges" of the state church. It is shown why the term "privilege" projects a pre-modern concept into the constitutional figure of positive religious freedom and thus regularly causes confusion in the debates. Two different justifications for positive religious freedom are discussed and weighted differently. Two misunderstandings are named, which the positive religious freedom regularly encounters. Finally, the mutual benefit is outlined, which is generated by positive religious freedom for all religious communities as well as for the plural and secular society.
