Subsequent to a more detailed specification of the concept of toleration die author shows that die legal system of the modern state in general - irrespective of constitutional guarantees such as religious freedom, freedom of speech, freedom of art and science - is based on principles of conduct that can be understood as an epitome of legalised or codified toleration to forms of expression of the intellectual and moral self fulfilment that are essential to man the idea of toleration then is solidified und substantiated to specific precepts of acceptance by the particular fundamental guarantees. What remains at last is an openness characterising the "system of intellectual freedom and toleration" that cannot be waived without losing one of this system's - as expressed once by the Constitutional Court - "vital elements" that provides a good share of its legitimation. Questions of right or wrong in a social community are not predetermined by absolute truth, but are decided in a permanent intellectual process of trial and error.
